Wills explained...

A will or testament is a legal declaration by which a person, the testator, names one or more persons to manage his or her estate and provides for the transfer of his or her property at death.

In the strictest sense, a "will" has historically been limited to real property, while "testament" applies only to dispositions of personal property, though this distinction is seldom observed today. A will may also create a testamentary trust that is effective only after the death of the testator.

Wills
Making a will properly means that if anything should happen to you, your estate will go where you want it to and this could mean that your loved ones can continue to be cared for after your death.

Even if you have no relatives, it is still important to make a will to benefit friends and causes you may care about, otherwise it is possible for your estate to fall into the hands of the Government.

Lasting Powers of Attorney
Lasting Powers of Attorney allow individuals to direct what will happen to their property and affairs and personal welfare in case of incapacity of any sort which can include old age and physical or mental incapacity.

They enable a person to give authority to one or more trusted people to manage and control their affairs or make decisions about their personal welfare; they can set out any necessary restrictions and they are also subject to controls laid down by law and supervised by the Office of the Public Guardian. They are becoming increasingly popular, especially for older people.

To discusss how this very useful provision can help you, please contact Helen Kloosman or Edward Lee.
